On March 1, 2024, this Court issued Order for Additional Information and to Temporarily Seal file. On March 13, 2024, Petitioner, Robert James Caves filed an Affidavit with Addendums attached thereto. Previously, Petitioner filed a Petition for Name Change (Safety at Risk). Within the Petition, Petitioner requested that the matter proceed as a sealed-record basis without publication as allowed by 27-31-201(3), MCA.
After having reviewed Petitioner's Affidavit and Addendums, the Court finds the Petitioner has failed to show probable cause that the safety of the Petitioner is at risk. The documentation provided the Court is vague and lacking in any details demonstrating an actual risk to the Petitioner.
THEREFORE, IT IS HEREBY ORDERED that:
Petitioner's request to proceed as a sealed-record basis is DENIED.
This matter shall be unsealed.
A hearing on the Petition for Name Change shall be held on Monday, May 13, 2024, at 10:00 A.M. at the courtroom of the Phillips County Courthouse in Malta, Montana.
The notice of hearing shall be published in the Phillips County News for four (4) consecutive weeks prior to the hearing. Failure to publish notice will result in the dismissal of this matter.
The Clerk shall send a copy of this Order to Petitioner.

New Opencut Mining Operation
As per the MT Department of Environmental Quality Opencut Division this notice is to inform the public of a proposed new sand and gravel mine. This site now known as
The L & T Anderson Pit
is located in Section(s) 26 & 35 T31N, R30E, Phillips County and includes 66 acres.
This site will be used for various area projects. Fisher Sand & Gravel Co. will be operating this site for the removal sand and gravel. A portable crushing spread will be moved on and off site as needed and may be operated 10 days on 4 days off 15 hours per day, however, if the projects require it may operate 24 hours per day. A portable Hot Mix Asphalt plant may be moved on and off site as needed and may operate 6 days per week 15 hours per day.

Malta Elementary School will soon destroy special education/speech-language therapy records of former students who have been out of school for at least five years. Former students may contact Amber Olsen at 406-654-2320 or their local school district within sixty days of this notice if they wish to review the files or obtain copies of the information contained in them. The information to be destroyed shall not include data collected on a routine basis that is maintained on all school children (such as the student's name, address, telephone number, grade level completed and year completed.)
The data to be destroyed shall include information collected for identification, location, evaluation, and other items directly related to special education services which the student had received. Parents of students still in school but not in special education for at least five (5) years may also request that their children's records be destroyed. Parents of these students also have the right to inspect the special education records and obtain copies of the information contained in those records before they are destroyed. Persons having questions about this process or those persons wishing to request that records be destroyed may contact Amber Olsen at (406) 654-2320 for assistance.

Notice of Close of Regular Voter Registration and Option for Late Registration
Notice is hereby given that regular* registration for the Federal General Election to be held on Tuesday,
June 4, 2024, will close at 5:00 p.m., on Monday, May 6, 2024.
All active and inactive**electors of Phillips County are entitled to vote at said election.
**Inactive electors may reactivate by appearing at the polling place in order to vote, and completing a new voter registration card, by requesting an absentee ballot from the Phillips County Election Office, or by notifying the Phillips County Election Administrator in writing of the elector's current address in the county.Persons who wish to register and who are not
presently registered may do so by requesting a form for registration by mail or by appearing at the

The Fort Belknap Indian Community (FBIC) is seeking bids for the reconstruction of one sweat house lodge. Location is on the Fort Belknap Indian Reservation. Bids will be accepted until May 10, 2024. Liability Insurance, TERO Compliance are required.
This IFB does not constitute a contract for services performed or to be performed. NOTICE OF SCHOOL MAIL BALLOT ELECTION
On Friday, April 19, 2024, the Phillips County Election Office mailed ballots for the upcoming Malta 14A & Whitewater 20D School District Elections. All active, registered voters should have received a ballot in the mail. This is a mail ballot election, there will be no polling place open for this election. This election will be tabulated by Hand Count.
Persons who are not registered to vote must appear in person at the Election Office with proper identification, register to vote and be issued a ballot. You may late register and vote in the election up until 8:00 p.m. on election day, Tuesday, May 7, 2024 by appearing in person at the Election office. All mailed ballots and ballots from late registrants must be received no later than 8:00 p.m. on Election Day, May 7, 2024 for your vote to count.
All inactive voters may receive a ballot by appearing in person or contacting the election office and presenting proper identification. This election is a mail ballot election. The Phillips County Election Office will be open 7 a.m. to 8 p.m. on Election Day, May 7, 2024. There will be no polling place open for this election.
Notice of Method of Counting Ballots
Mail ballots for the May 7, 2024 Malta 14A and Whitewater 20D School District elections will be removed from their secrecy envelopes starting at 2 p.m. on Tuesday, May 7, 2024 at the Phillips County Election Office, 314 S 2nd Ave W, Malta.
Votes will be counted beginning at 4 p.m. on Tuesday, May 7, 2024 in the Phillips County Election Office as specified in 13-15-201, MCA by hand-count. Vote counting procedures are open to public observation. Any person observing the procedures of the count must complete and sign an affirmation stating, ""I, _____, will not discuss the results of the early counting of votes at any time prior to the closing of the polls on election day," and is subject to 13-35-241, MCA:
13-35-241. Release of vote tally -- penalty. (1) A person may not
make public the results of a vote tally from a precinct until after the
polls close as provided in 13-1-106.
(2)(a) A person who knowingly violates subsection (1) shall be
imprisoned in the state prison for a term not to exceed 2 years or be
fined an amount not less than $100,000 and not more than $500,000,
or both.
(b) For the purposes of this section "knowingly" has the meaning
specified in 45-2-101.
Results will be posted after 8 p.m. on Election Day, Tuesday, May 7, 2024 when the hand count is finished.
Accepted provisional ballots will be counted and added to the vote totals at 3 p.m. on Monday, May 13, 2024 in Phillips County Election Office, 314 S 2nd Ave W, Malta.

EXPRESSVOTES WILL BE AVAILABLE FOR ALL MUNICIPAL ELECTIONS AT THE PHILLIPS COUNTY ELECTION OFFICE:
The ExpressVote is a ballot-marking system that is available for anyone to use during the upcoming election. Its main purpose is
to allow voters with disabilities and other special needs to mark a ballot privately and independently.
1. Inform the election official that you wish to vote using ExpressVote.
2. You will be issued a ballot card.
3. Insert the ballot card into the ballot feed tray on the front of the machine.
4. The screen will display instructions and the ballot choices.
5. The following helpful options are available:
a. Change contrast and font size for readability
b. Audio headphones
c. Braille keypad
d. Connection for Sip-n-Puff personal device
6. Make your selections by using the touch-screen capability, or by using the keypad.
7. After you have completed your selections, the ExpressVote will confirm your
selections on the screen, and by audio if you select the audio option.
8. After verifying your selections, the ExpressVote will mark and print out your
ballot card.
9. Confirm your choices on the printed and marked ballot card.
10. Return the marked ballot card to the election official.
