GRANDSTANDS IMPROVEMENTS
PHILLIPS COUNTY, MONTANA
NOTICE IS GIVEN that Phillips County Commissioners will receive separate sealed bids for the construction of
the GRANDSTAND IMPROVEMENTS project until Monday, March 25, 2024 at 2:00 pm. No bids may be
withdrawn after the scheduled time for the bid opening.
Bids must addressed to and delivered by one of the following methods:
1. Mailed to the office of the Owner - Phillips County Clerk and Recorder, 314 S. 2nd West, PO
Box 360, Malta, MT 59538-9643.
2. Delivered to the office of the Owner - Phillips County Clerk and Recorder, 314 S. 2nd West,
Malta, MT 59538-9643.
All Bids will be opened and publicly announced by the Phillips County Commissioners on Monday, March 25, 2024
at 2:00 pm (Local Time).
1. Base Bid:
a. The work generally consists of:
Precast concrete grandstand construction, including foundation, steel superstructure,
and steel canopy for the Phillips County Fairgrounds.
The contract may be awarded based on the OWNER’s best interests. The award will be based on the lowest cost
combination of responsive, responsible bids, on the Base Bid and various Schedules, Alternatives, and Additive
Alternate, as applicable, selected by the OWNER.
Contract Time:
1. Base Bid:
a. All construction schedules shall be substantially complete and ready for OWNER’s use and
pre-final inspection by June 30, 2025.
b. Work shall not begin on the project prior to August 12, 2024
2. All construction schedules shall be finally complete and ready for final payment within (30)
calendar days of Substantial Completion.
Liquidated Damages:
1. The CONTRACTOR shall pay the OWNER $1,750, for each calendar day or part of a day that
expires after the time specified for Substantial Completion of any construction schedule(s) until
the Work is substantially complete.
2. The CONTRACTOR shall also pay the OWNER $250 , for each calendar day or part of a day that
expires after the time specified for Final Completion and payment until the Work is finally complete.

Bidders must download the bidding documents from either QuestCDN or receive paper copies from the office of
record to be a registered bidder and receive addenda and any other information issued by the ENGINEER or
OWNER. Addenda and other information will not be sent to Bidders that obtain copies of the bidding documents
from other sources.
CONTRACTOR and any of the CONTRACTOR’s Subcontractors doing work on this project will be required to
obtain registration with the Montana Department of Labor and Industry (DLI). . Forms for registration are available
from the Department of Labor and Industry at P.O. Box 8011, 1805 Prospect Avenue, Helena, Montana 59604-
8011. Information on registration can be obtained by calling 1-406-444-7734. CONTRACTOR is required to have
registered with the DLI prior to bidding on this project and all laborers and mechanics employed by the
CONTRACTOR or Subcontractors in performance of the construction work shall be paid wages at rates as required
by the Laws of the State the work is being performed. The CONTRACTOR must ensure that employees and
applicants for employment are not discriminated against because of their race, color, religion, sex, or national
origin.
Each bid or proposal must be accompanied by a certified check, cashier’s check, or bid bond payable to the
OWNER, in an amount not less than ten percent (10%) of the total amount of the bid. Successful bidders shall
furnish an approved Performance Bond and a labor and materials Payment Bond, each in the amount of one
hundred percent (100%) of the contract amount. Insurance, as required, shall be provided by the successful
bidder(s) and a certificate(s) of that insurance shall be provided. The bid bond, a copy of the CONTRACTOR’s
license or certificate of renewal, and applicable funding requirement forms shall be included with each bid of
proposal. All bids must be sealed.
Pre-bid conference information:
1. There will not be a pre-bid conference.
No bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses,
and any deficient bid submitted will be resealed and returned to the Bidder immediately.
The OWNER reserves the right to hold all bids and bid securities for a period not to exceed thirty (30) days and to
hold the three low bids and bid securities for a period not to exceed sixty (60) days from the date of the bid opening.
The OWNER may, in its sole discretion, release any Bid and return the Bid security prior to the end of these periods,
waive any informality in any bid, and to reject the bid of any party who has been delinquent or unfaithful in the
performance of any former contract with the OWNER.

PUBLIC HEARING
The City of Malta will conduct a Public Hearing March 12, 2024 at 5:00 p.m. in the Council Chambers of City Hall. The purpose of the public hearing is to receive public comments concerning Resolution 1343. A Resolution Naming Repair and Maintenance Projects Pursuant to State-Local Infrastructure Partnership Ace (HB 355) Funding. The Resolution will be available for inspection at City Hall on March 7, 2024.

Invitation for Bids
The Fort Belknap Indian Community (FBIC) is seeking bids for the reconstruction of two (2) standard-size baseball fields. The location is on the Fort Belknap Indian Reservation. Bids will be accepted until March 20th, 2024. Liability Insurance, TERO Compliance, System for Award Management (SAM.gov) registration and DUNS number are required.
This IFB does not constitute a contract for services performed or to be performed. Following the selection of the successful consultant, the FBIC and contractor will negotiate a contract including the full scope of services. The project scope of work can be requested via email from Amy Stewart,

Proposals will be accepted via email up until March 20th, 2024, at 5:00 p.m. (MST). Screening and selections will be made by the Tiwahe Initiative committee.

NOTICE OF TRUSTEE’S SALE
To be sold for cash at a Trustee’s Sale on June 17, 2024, at 11:00 AM on the front steps of the Phillips County Courthouse, 314 South Second Avenue W, Malta, MT, the following described real property situated in Phillips County, State of Montana:

Jason J. Henderson is the Successor Trustee pursuant to a Substitution of Trustee recorded in the office of the Clerk and Recorder of Phillips County, State of Montana, on January 18, 2024 as Instrument No. 362437, in Book Doc 106, at Page 346-347, of Official Records.
The Beneficiary has declared a default in the terms of said Deed of Trust due to the Grantor(s) failure to make monthly payments beginning September 1, 2022, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. By reason of said default, the Beneficiary has declared all sums owing on the obligation secured by said Trust Deed immediately due and payable. The total amount due on this obligation is the principal sum of $78,978.01, interest in the sum of $3,645.32, other amounts due and payable in the amount of $6,099.12 for a total amount owing of $88,722.45, plus accruing interest, late charges, and other fees and costs that may be incurred or advanced.
The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantor. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee’s fees and attorney’s fees, costs and expenses of the sale, and late charges, if any.
Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation.
The sale is a public sale and any person, including the Beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier’s checks). The conveyance will be made by Trustee’s Deed, without any representation or warranty, including warranty of title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale.
The Grantor, successor in interest to the Grantor, or any other person having an interest in the property, has the right, at any time prior to the Trustee’s Sale, to pay to the Beneficiary, or the successor in interest to the Beneficiary, the entire amount then due under the Deed of Trust and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust with Successor Trustee’s and attorney’s fees. In the event that all defaults are cured, the foreclosure will be dismissed and the foreclosure sale will be canceled.
The scheduled Trustee’s Sale may be postponed by public proclamation up to 15 days for any reason. In the event of a bankruptcy filing, the sale may be postponed by the Trustee for up to 120 days by public proclamation at least every 30 days.
If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Successor Trustee and the successful bidder shall have no further recourse.
This is an attempt to collect a debt and any information obtained will be used for that purpose.
