RESOLUTION OF THE BOARD OF TRUSTEES OF MALTA K-12 SCHOOL
DISTRICT NO. 14A,
PHILLIPS COUNTY
TO DISPOSE OF DISTRICT PERSONAL PROPERTY
Whereas, the Boards of Trustees of Malta K-12 School District No. 14A, Phillips County (herein after the “School District”); holds in trust all real and personal property of the School District; MCA § 20-6-602; Whereas, the Board is authorized under Montana law to sell or otherwise dispose of School District property that is or is about to become abandoned, obsolete, undesirable, or unsuitable for school purposes; MCA § 20-6-604;
Whereas, the Board must follow a certain procedure to sell or otherwise dispose of School District
property, including the adoption of a property disposal resolution and notice of any such resolution; any such resolution is subject to appeal by a taxpayer under Montana law; MCA § 20-6-604;
Whereas, once the legal appeal period has passed after the adoption of such a resolution or the resolution, if appealed, has been upheld by a court, the Board may sell or dispose of the property subject to such a resolution in any reasonable manner that the Board determines to be in the best interests of the School District; MCA § 20-6-604; and
Whereas, the Lease and Lease Approvements the School District has legal right to, if any, with a formal
description of: Principal Meridian Montana, T. 25N., R. 25 E., Sec. 16: NE ¼ SE ¼ SW ¼, or otherwise
described as the Zortman School and/or Zortman School Lease and accompanying lands and all
improvements, are herein determined by the Board of Trustees to be abandoned, obsolete, undesirable, or unsuitable for the school purposes of the School District.
Therefore, be it resolved that the Board hereby determines that the Zortman School Lease as described above is or is about to become abandoned, obsolete, undesirable, or unsuitable for school purposes;
It is further resolved that the Superintendent is authorized to otherwise dispose of the property listed above by way of transferring the School District’s right and obligations under the Zortman School Lease, if any, to the Zortman Volunteer Fire Department, through coordination with Bureau of Land Management, if a transfer of said Lease can be mutually agreed to by the interested parties, including the School District.
The trustees of the Malta School District further resolve that notices of the resolution shall be published on the 20th and 27th days of December 2023, in the Phillips County News newspaper.
This resolution shall become effective 14 days after publication of the second notice identified in the
immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with
and as provided in §20-6-604, MCA.
It is further resolved that this Resolution shall not be effective and the property subject to this Resolution
shall not be sold or otherwise disposed of until the appeal period provided for in Montana law as passed; MCA § 20-6-604(2).

DISPOSITION OF OBSOLETE AND UNDESIRABLE PROPERTY
Notice is hereby given as required by Section 20-6-604, MCA, the Board of Trustees of Malta School District 14A adopted a resolution at a regular trustee meeting on December 13, 2023 to dispose of School District Property.
Specifically, the Lease and Lease Approvements the School District has legal right to, if any, with a formal description of: Principal Meridian Montana, T. 25N., R. 25 E., Sec. 16: NE ¼ SE ¼ SW ¼, or otherwise described as the Zortman School and/or Zortman
School Lease and accompanying lands and all improvements; by way of transferring the School District’s right and obligations under the Zortman School Lease, if any, to the Zortman Volunteer Fire Department, through coordination with Bureau of Land Management, if a transfer of said Lease can be mutually agreed to by the interested parties, including the School District.
For more information, you may phone the school office at 654-1871. Any taxpayer of the district may appeal this resolution to district court any time prior to the effective date of this resolution. The effective day of the resolution will be January 10, 2024.
