NOTICE OF LAND SALE
Larry Ochsner, Leann Ochsner, and Robert D. Ochsner will sell to the highest bidder, for cash, the following real property located in Phillips County Montana which is described as follows:
Parcel 1:
Township 35 North, Range 31 East
Section 4: Lots 1 and 2, S½NE¼, SE¼
Township 36 North, Range 31 East
Section 11: SE¼
Section 14: NE¼
Parcel 2:
Township 34 North, Range 33 East
Section 19: W½SE¼
Section 30: Lot 3, W½E½, NE¼SW¼
Township 35 North, Range 32 East
Section 35: W½
TERMS AND CONDITIONS OF SALE:
Sealed bids will be received on the real property at any time prior to 11:00 a.m. on November 18, 2019. Bids must be in a sealed envelope, must state if they are for Parcel 1, Parcel 2, or the entire property and must be submitted to the Law Office of Cole, Amestoy & O’Brien, PLLP, P.O. Box 1280, 113 South 2nd Street W., Malta, Montana 59538 prior to the above time.
Ten percent (10%) of the amount of the bid in the form of certified funds must be delivered to the Closing Agent within five (5) days of the bid acceptance. The successful bidder shall pay the balance of the purchase price on the date of Closing, which shall occur for Parcel 1 on December 20, 2019 and Parcel 2 on January 7, 2020.
Seller states that all farm land is organic farming a portion of the property is subject to Lease which will expire December 31, 2022. A copy of the lease will be available to interested bidders. Also, one property is in CRP until the fall of 2020.
Real property taxes for 2019 shall be paid by Seller.
Seller and Purchaser shall each pay one-half of the Closing Agents’ fees and costs.
Seller will accept bids for Parcel 1, Parcel 2, and for the whole property. Seller reserves the right to sell the property in parcels or as a whole.
Seller will provide a standard owners title insurance policy and a preliminary commitment of title will be available for review by interested bidders.
Seller shall retain any and all mineral rights existing on the property.
Seller shall retain 25% of wind and solar power development and royalty rights on the property.
Sealed bids will be opened at 1:00 p.m. on November 18, 2019.
Seller reserves the right to reject any or all bids.

NOTICE OF TAXES DUE
2019 Real Property taxes have been mailed and notice is hereby given that the first half of all taxes levied and assessed will be due and payable before 5 p.m. on Monday, December 2, 2019 and that unless paid prior to that time the amount then due will be delinquent and will draw interest at the rate of 5/6 of 1% per month from the time of delinquency until paid and 2% will be added to the delinquent taxes as a penalty.
And that the second half of all taxes levied and assessed will be due and payable on or before 5:00 p.m. on June 1, 2020, and that unless paid prior to that time the taxes will be delinquent until paid, and 2% will be added to the delinquent taxes as a penalty.

Hearing before the Board of Adjustment - In the Matter of American Prairie Reserve's Petition for Variance from Phillips Conservation District Ordinance 2016-1
MALTA, Mont - The Phillips Conservation District Board of Adjustment will convene at 9:00am on November 12, 2019 at the Malta City Hall Gym, 39 South 2nd Street, Malta, MT. The primary purpose of the meeting is for the Board to hold a hearing on American Prairie Reserve's petition for a variance from the Phillips Conservation District Ordinance 2016-1. The hearing is a contested case proceeding overseen by a hearing examiner appointed by the Board and conducted pursuant to §§ 2-4-601 through 2-4-631 and 76-15-724, MCA. Only parties to the proceeding are entitled to appear and present evidence and testimony for consideration by the Board and hearing examiner during the hearing. The hearing is open to the public.
