NOTICE OF SEWER RATE INCREASE
AND PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on October 8, 2019, the City Council (the “Council”) of the City of Malta, Montana (the “City”), adopted a Resolution of Intention of the City of Malta, Montana to Increase Rates and Charges for the Use and Availability of the Municipal Sewer System (the “Resolution”).
The City has determined it is necessary to undertake certain improvements to the City’s municipal sewer system (the “System”) on an emergency basis, and anticipates issuing sewer system revenue bonds to pay the costs of such improvements. It is necessary for the City to increase its sewer rates to to pay the costs associated with the operation and maintenance of the System, pay debt service on its outstanding bonds and the bonds proposed to be issued, and to establish appropriate reserves.
The City currently charges users of the System a monthly rate of $33.00 per unit, with each type of service assigned a particular number of units, as set forth below:
Commencing with the December 2019 billing, the City proposes to charge customers connected to the System a monthly charge (the “Proposed Monthly Charge”) of $37.50 per unit, based on the units set forth above.
In addition, the City currently charges unoccupied units $5 per month. Commencing with the December 2019 billing, the City proposes to charge unoccupied units the full Proposed Monthly Charge for such unit.
For occupied units, the Proposed Monthly Charge represents an increase of approximately 13.6% over the current monthly charge. For unoccupied units comprising one unit, the Proposed Monthly Charge represents an increase of approximately 650% over the current monthly charge.
A public hearing on the proposed rate increase will be held on November 12, 2019, commencing at 5:00 p.m., at Malta City Hall, 39 South 2nd Street East, in Malta, Montana.

The permit area covers approximately 14 acres, 80,000 tons of gravel are planned to be mined. The volume of overburden is 24,038 cubic yards. The facilities will include a screen, conveyor and crushing equipment. The duration of mining activity will be approximately 2 weeks. The access point to the site is an existing trail off a county road. In accordance with MCA 82-4-432 (9), the DEQ must hold a public meeting in the area of the proposed operation if requested by the applicant, or at least 30% of the property owners within one half mile of the boundary or 10 property owners within one half mile of the boundary, whichever is greater. For property held in common or joint ownership, each owner is considered in determining the number of property owners and the number of property owners who have requested a public meeting. The Trustees of School District No 12 A & B further resolve that notices of the resolution shall be published on October 16, 2019 and October 23, 2019, in the Phillips County News newspaper.
This resolution shall become effective 14 days after publication of the second notice identified in the immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with and as provided in 20-6-604, MCA.

NOTICE OF SECOND READING TO ADOPT AN ORDINANCE DECLARING THE SALE AND PUBLIC USE OF MEDICAL MARIJUANA TO BE A NUISANCE IN THE UNINCORPORATED AREAS OF PHILLIPS COUNTY, MONTANA OUTSIDE OF THE BOARDARIES OF THE CITY OF MALTA, TOWN OF SACO AND TOWN OF DODSON.
The Phillips County Commissioners will conduct the second reading and receive public input on whether or not to adopt an Ordinance to prohibit the growth, sale and distribution, of medical marijuana, and any establishment attempting to grow, sell or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco or Town of Dodson.
The Phillips County Commission has determined that the licensing, opening or operation of any establishments that grow, sell, or distribute medical marijuana or paraphernalia within Phillips County could be detrimental to, harmful to, and a threat to the peace, property, health, safety and welfare of the County and its inhabitants and can, through such an effect, create a public nuisance and have completed the first reading of an ordinance to regulate medical marijuana growth, sale, and distribution, and any establishment attempting to grow, sell or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco, or Town of Dodson.
Until such new ordinances, zoning or otherwise, are adopted and in place to regulate medical marijuana growth, sale and distribution, any establishment attempting to grow, sell or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco or Town of Dodson, shall be prohibited. The ordinance specifically prohibits any new or lawfully existing medical marijuana provide or marijuana-infused products provider from establishing a dispensary or grow operation, or expanding the number of plants currently growing on the property. This prohibition shall not apply to a registered cardholder who possesses not more than four mature marijuana plants, twelve seedlings and one ounce of usable marijuana as provided by the Act, nor shall it apply to a provider, already registered with the Phillips County Sanitarian and in operation at their designated location on the date this Ordinance, who possesses not more than four mature marijuana plants, twelve seedlings and one ounce of usable marijuana solely for each of his or her registered cardholder’s use or as provided the Montana Marijuana Act.
The ordinance is on file for public inspection at the Office of the Phillips County Clerk and Recorder.
The second reading will be held in the office of the Phillips County Commissioners, Phillips County Courthouse, 314 South 2nd Avenue West, Malta MT at 2:00 pm on October 21, 2019. At such hearing members of the public will be encouraged to offer comment on the proposed Ordinance and any person not able to attend the hearing may submit written comments prior to the hearing, by sending or delivering such comments to the Board of County Commissioners, Box 360, Malta, MT 59538.

NOTICE OF UPCOMING MUNICIPAL MAIL BALLOT ELECTION
On Friday, October 18, 2019, the Phillips County Election Office will mail ballots for the upcoming Town of Dodson Municipal General Election to be held Tuesday, November 5, 2019. This is a mail ballot election, all active registered voters in the Town of Dodson will receive a ballot by mail.
Persons who are not registered to vote must appear in person at the Election Office with proper identification, register to vote and be issued a ballot. All mailed ballots and ballots from late registrants must be received no later than 8:00 p.m. on Election Day, November 5, 2019 for your vote to count.
All inactive voters may receive a ballot by appearing in person or contacting the election office and presenting proper identification. The Phillips County Election Office is located in the County Courthouse at 314 S 2nd Ave W, Malta MT and open from 8:00 a.m. to 5:00 p.m. Monday through Friday and 7:00 a.m. to 8:00 p.m. on Election Day, November 5, 2019.
