Notice of Audit Publication

An audit of the affairs of the City of Malta has been conducted by WIPFLi CPAs & Consultants. The audit covered the fiscal year ending June 30, 2016. Section 2-7-521, MCA, requires the publication of the following summary of significant findings.

Summary of Significant Findings:

The audit report for the City of Malta for the fiscal year ending June 30, 2016 contains an independent Auditor’s Report on the City’s basic financial statements. The report issued for the fiscal year ended June 20, 2016 contains opinions.

The audit report also contains several other auditor’s reports. Following is a list of the findings.

Finding #1 Journal Entries

Criteria or specific Requirements: Review and support for adjusting journal entries are an important internal control activity performed by management to ensure account balances are recorded, presented and fairly reported.

Condition: During the audit, it was noted that no process was in place to keep supporting documentation pertaining to adjusting journal entries made into the accounting system. Furthermore adjusting journal entries made into the accounting system are not being reviewed for accuracy or to determine if the entry is necessary.

Context: We made inquiries of management and review of adjusting journal entries made into the accounting system.

Effect: Without proper supporting documentation and review of adjusting journal entries information in the accounting system can be changed without a proper trail to determine the business rationale for the adjustment.

Cause: The City does not have adequate policies and procedures pertaining to making adjusting journal entries into the accounting software.

Recommendation: The City should create a process and procedure to ensure that all adjusting journal entries are properly supported and approved by the appropriate level of management.

NOTICE TO THE PUBLIC OF ADOPTION OF UPDATED

FLOOD PLAIN REGULATIONS

The Phillips County Commissioners will hold a Public Hearing on the resolution to adopt updated flood plain regulations in Phillips County. The proposed update is for all Phillips County outside any incorporated cities. The updated regulation will be available to the public for review at the Phillips County Clerk and Recorder’s office.

The HEARING will be held on the 19th day of April, 2017, at the Phillips County Court House downstairs boardroom in Malta, MT at 5:00 p.m., at which time all interested persons will be given the opportunity to comment.

NOTICE OF TRUSTEE'S SALE

TO BE SOLD FOR CASH AT TRUSTEE'S SALE on July 12, 2017, at 11:00 a.m. at the East Door of the Phillips County Courthouse located at 314 South 2nd Avenue West in Malta, MT 59538, the following described real property situated in Phillips County, Montana:

Lots 4 and 5 in Block 6 of the Townsite of Saco, Phillips County, Montana, according to the official recorded plat thereof.

CINDY ALLEN and RONALD ALLEN, as Grantors, conveyed said real property to SHALOM RUBANOWITZ, as Trustee,

The beneficiary has declared a default in the terms of said Deed of Trust by failing to make the monthly payments beginning April 1, 2016, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. The total amount due on this obligation as of November 8, 2016 is $88,901.70 principal, interest totaling $2,438.92 late charges in the amount of $112.75, escrow advances of $694.63, and other fees and expenses advanced of $309.50, plus accruing interest, late charges, and other costs and fees that may be advanced.

The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee's fees and attorney's fees, costs and expenses of the sale and late charges, if any.

Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation.

The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier’s checks). The conveyance will be made by Trustee’s Deed without any representation or warranty, including warranty of Title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale.

The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the trustee’s sale, may pay to the beneficiary or the successor in interest to the beneficiary the entire amount then due under the deed of trust and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default.

The scheduled Trustee’s Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days.

Notice of Close of Regular Voter Registration and Option for Late Registration

Notice is hereby given, that regular* registration for the SPECIAL Election to fill the U.S. Representative vacancy to be held on Thursday, May 25, 2017 in the County of PHILLIPS, will close at 5:00 p.m., on April 25, 2017.

*NOTE: If you miss this regular registration deadline, you may still register for the election by showing up at the county election office up to and including on election day. Between noon and the close of business on the day before election day,

you can complete and submit a voter registration form, but you will need to return to the local election office on election day

to pick up and vote a ballot.

All active and inactive**electors of PHILLIPS County are entitled to vote at said election.

**Inactive electors may reactivate by appearing at the polling place in order to vote, by requesting an absentee ballot in any election, or by notifying the County Election Administrator in writing of the elector's current address in the county.

The Legislature is currently considering legislation that would determine how the election is conducted. If, as a result of the legislation, the election is conducted by mail ballot, ballots will be automatically mailed to Active Electors only.
