Since January of 2016 the Phillips County Sheriff’s Office has arrested close to a dozen individuals and issued nearly two dozen citations for misdemeanor drug possession and possession of drug paraphernalia. Most of the cases are still under investigation, and the suspects do include juveniles.
Montana Code 45-9-102 misdemeanor possession of dangerous drugs is any amount of marijuana which does not exceed 60grams. This does not apply to that drug which is packaged or intended for distribution or resale which constitutes a felony. A person convicted of misdemeanor possession of marijuana or its derivatives upon first offense shall be punished by a fine of not less than $100 or more than $500 and by imprisonment in the county jail for not more than 6 months.
Justice of the Peace Gayle Stahl has taken the position that anyone convicted will be fined the maximum amount of $500 per charge and a minimum of 5 days in jail for the first offense. Subsequent offences will carry more serious consequences.
