REQUEST FOR ENGINEERING QUALIFICATIONS

for the

MALTA IRRIGATION DISTRICT

The Malta Irrigation District (MID) is requesting Statement of Qualifications (SOQ) from engineering firms interested in performing general engineering services for an approximate five-year time period through 2020. Potential projects include canal lining, concrete repairs, siphons, checks and head gates, and other irrigation enhancements, management improvements and conservation projects.

The engineering services required under this request may include, but are not necessarily limited to the following:

1. Legal, land and topographical surveying services.

2. Preparation of Preliminary Engineering Reports (PERs).

3. Preparation of final designs, details, specifications, and bid documents.

4. Contractor solicitation and bid administration.

5. Construction management, inspection and testing.

6. Assistance with grant administration and funding compliance.

7. Other services as deemed necessary by the MID.

Requirements for the Statement of Qualifications shall include the following information:

1. Statement of qualifications to perform the requested services.

2. Provide experience and qualifications of personnel to be assigned to these projects.

3. A brief listing of 10 related projects the firm has undertaken for the MID and other Montana irrigation districts, including scope of work, construction estimate, and contact information.

4. List experience with other Milk River Basin stakeholders and USBR irrigation districts.

5. Discuss firm location and ability to meet project requirements over 5-year term.

6. List subconsultants proposed for this project.

7. Limit SOQs to 30 pages total excluding cover, back and section dividers.

A Review Committee will rank each Statement of Qualifications according to the following criteria. Particular attention will be given to experience with similar irrigation districts or the Milk River Basin.

1. Experience with irrigation infrastructure and conservation projects 30%

2. Past work with the MID or within Milk River Basin 30%

3. Qualifications of personnel assigned to the project 15%

4. Location of Office and personnel assigned to the project 15%

5. Experience with USBR districts 10%

The three (3) engineering firms ranked highest by the Review Committee may be asked to provide additional written information or be invited for interviews. However, the MID reserves the right to select an engineering firm based solely on information presented in the SOQ. Contract negotiations will commence as soon as possible.

DISPOSITION OF OBSOLETE AND UNDESIRABLE PROPERTY

Notice is hereby given as required by Section 20-6-604, MCA, the Board of Trustees of Dodson School District 2A-C adopted a resolution at a regular trustee meeting on July 14, 2015 to dispose of abandoned, obsolete and undesirable property of minimal value, including some kitchen utensils, a large heavy wood table, lunch trays, stacked file tray and a computer desk. Items may be viewed at the Dodson School Thursday, August 13, 2015, from 7 a.m. to 2 p.m. For more information you may phone the school office at 383-4361. Any taxpayer of the district may appeal this resolution to district court anytime prior to the effective date of this resolution. If you are interested in purchasing any of these items, please come to the school to view the items and offer a purchase price. The effective day of the resolution will be August 12, 2015.

IRRIGATION RELEASES FROM FRESNO RESERVOIR AND NELSON RESERVOIR TO STOP ON AUGUST 25, 2015

Due to the lack of water inflows and current conditions of the reservoirs throughout the Milk River Basin, until further notice Malta Irrigation District (MID) will only supply this second irrigation to water users no later than August 25, 2015. If irrigators do not have irrigation complete by this time, no additional water will be supplied.

MID stresses that water users will not be able to receive a third or fourth irrigation to fields. Water users will not be allowed to transfer water rights from one field to another in order to irrigate a field a third time.

NOTICE OF TRUSTEE'S SALE

TO BE SOLD FOR CASH AT TRUSTEE'S SALE on September 15, 2015, at 11:00 o'clock A.M. at the East Door of the Phillips County Courthouse located at 314 South 2nd Avenue West in Malta, MT 59538, the following described real property situated in Phillips County, Montana:

Certificate of Survey #281, Phillips County, Montana, being a tract of land in the S1/2NE1/4SW1/4 of Section 7, Township 30 North, Range 30 East, M.P.M.

Daniel J. Anderson, as Grantor(s), conveyed said real property to Phillips County Title Co., as Trustee, to secure an obligation owed to Mortgage Electronic Registration Systems, Inc. as Nominee for Home Owners Mortgage Equity Corp, it’s successors and assigns, as Beneficiary, by Deed of Trust dated on July 22, 2010 and recorded on July 26, 2010 in Book 45, Page 61 as Document No. 341363. The beneficial interest is currently held by U.S. BANK NATIONAL ASSOCIATION. First American Title Company of Montana, Inc., is the Successor Trustee pursuant to a Substitution of Trustee recorded in the office of the Clerk and Recorder of Phillips County, Montana.

The beneficiary has declared a default in the terms of said Deed of Trust by failing to make the monthly payments due in the amount of $516.77, beginning November 1, 2014, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. The total amount due on this obligation as of May 21, 2015 is $92,188.62 principal, interest at the rate of 4.75000% totaling $2,794.31, escrow advances of $375.79, plus accruing interest at the rate of $12.00 per diem, late charges, and other costs and fees that may be advanced.

The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee's fees and attorney's fees, costs and expenses of the sale and late charges, if any.

Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation.

The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier’s checks). The conveyance will be made by Trustee’s Deed without any representation or warranty, including warranty of Title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale.

The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the trustee’s sale, may pay to the beneficiary or the successor in interest to the beneficiary the entire amount then due under the deed of trust and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default.

The scheduled Trustee’s Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days.
